Trail Pony

Terms of service

1. Who we are and what this is

These terms are an agreement between you and Trail Pony, a sole proprietorship in Whitehorse, Yukon, Canada ("Trail Pony", "we"). By creating an account you accept them. You must be 18 or older, or the age of majority where you live if that is higher.

Trail Pony is a contact you text from a satellite messenger or phone. It answers questions and sends forecasts and other information. The answers are written by artificial intelligence (AI) using the messages you send, the trip details you give us, your position when your device shares it, and live data such as weather forecasts.

2. Read this part: the outdoors is dangerous and this is not a safety service

Trail Pony gives information only. It is not an emergency service, it is not a guide, and it cannot rescue you. In an emergency, use your device's SOS function or call emergency services.

  • We don't watch over you. Trail Pony never contacts emergency services, your family or anyone else on your behalf, and it does not notice or act if you stop texting. Nothing in these terms creates a duty to monitor you or to rescue you.
  • Answers can be wrong. AI makes mistakes, and it can sound confident when it is wrong. Treat every answer as one input to your own judgment.
  • Forecasts come from third-party weather providers. They are predictions, often wrong in the mountains and the north, and decisions you make on them are yours.
  • Health and first aid: answers about injuries or illness are general first-aid information, not medical advice or diagnosis.
  • Rules and regulations: answers about hunting and fishing seasons, licences, permits, fire bans, closures or other rules are not official. Check the authority that issues them before you rely on one.
  • Messages can be late or never arrive. Delivery depends on satellites, carriers, your device, your plan and services we don't control. Never depend on Trail Pony as your only source of information or your only way to reach anyone.
  • You make your own decisions. Where to go, whether to cross, when to turn back, what to eat or drink: these are yours. Trail Pony does not tell you which way to go, and it will not tell you a plant or mushroom is safe to eat.
  • You accept the risks of the activities you do, including injury, death and loss of property, to the extent the law where you live allows.

3. Your account and your address

  • You get your own address to text. Keep it to yourself. Anyone who texts it from your paired device is treated as you.
  • Give us accurate details, keep your sign-in email secure, and tell us if you think someone else is using your account.
  • One account per person. The group plan, when it exists, is how several people share.

4. Plans, payment and cancelling

  • Monthly plan: US$12 a month, unlimited messages. It renews automatically every month and charges your card until you cancel or pause it. You can cancel or pause any time on your account page, online, in a few clicks. Cancelling stops the next charge; you keep service until the end of the period you paid for.
  • Trip pass: US$20 for 14 days, unlimited messages. It does not renew.
  • Unlimited means no message counting on our side. To protect the service from faults and misuse (such as two systems stuck replying to each other, or automated traffic), we may pause or slow an account that sends far more than any person could, and we tell you if we do.
  • Satellite and carrier charges are yours. Every message you send to Trail Pony and every reply counts against your device or phone plan, like any text; those charges are between you and your provider.
  • Replies that don't arrive are not refunded or credited, whatever the cause.
  • Price changes: we tell you at least 30 days before a new price applies to you, and you can cancel before it does. Once a year we remind you of your plan, its price and how to cancel.
  • Refunds: we don't refund partly used periods or passes, except where the law requires or where we decide to. If the service fails you, write to us.
  • Promotion codes are free time or free trips, as described when you get one. A free period on the monthly plan turns into a paid one when it ends, and we remind you before that happens.

5. Text messages

Trail Pony sends replies to the messages you send it, plus messages you turn on yourself, such as the morning briefing. How often you get messages depends on how you use it. Message and data rates may apply, and your satellite provider may bill messages under your device plan. Text HELP for help. Text STOP at any time to stop messages; you get one final confirmation and nothing more. Agreeing to receive messages is never a condition of buying anything else.

6. Your information

How we collect, use and delete your information is in our Privacy Policy. In short: your trip, positions and messages are deleted after the trip ends unless you choose to keep the trip; information not tied to a trip is deleted after 30 days unless you choose to keep your history; we never sell your data; and forecast providers get coordinates only, never who you are. To write answers, we send your messages and the minimum context needed to an AI provider. Messages can contain your location. We disclose your information to authorities only when the law requires it.

7. Using it fairly

Don't use Trail Pony to break the law, harass anyone, send spam or messages to people who haven't agreed to get them, try to get into other people's accounts or our systems, or run automated traffic through it. We may limit, suspend or close an account that does. If we close your account for any other reason, we refund the unused part of what you paid.

8. Our service can change

We improve Trail Pony and sometimes change or stop features. We don't promise it will always be available or free of errors. If we stop the service entirely, we tell you in advance and refund unused time.

9. Limits on our liability

To the extent the law where you live allows:

  • Trail Pony is provided "as is". We make no promises about the accuracy, completeness or timeliness of answers, forecasts or delivery beyond what these terms say.
  • We are not responsible for indirect or consequential losses, such as a missed hunt, a changed trip, lost bookings or lost profit.
  • Our total responsibility to you for any claim is limited to the greater of what you paid us in the 12 months before the claim and CAD $50.

Nothing in these terms limits liability that the law does not allow to be limited, including for our gross negligence, fraud or intentional misconduct, or for death or personal injury where your local law prohibits that limit, and nothing removes rights that consumer law in your province, state or country gives you.

10. Disagreements

Write to us first; most problems are fixed that way. These terms are governed by the laws of Yukon and of Canada that apply there, and disputes go to the courts of Yukon. If you are a consumer and the law where you live gives you the right to use your own courts or its consumer laws, you keep that right. Nothing here makes you give up a class action or forces you into arbitration.

11. Changes to these terms

If we change these terms in a way that matters, we email you at least 30 days before the change applies. If you keep using Trail Pony after that, the new terms apply; if you don't agree, cancel before then.
